The free service
Outpace lets friends and groups compare step totals and gives daily winners the ability to choose a shared background image, subject to the Competition Rules and photo review. The release covered by these Terms is free. It does not offer paid entries, cash prizes, withdrawals, charitable transfers or subscriptions.
Any play points are non-redeemable in-app points. They have no cash value and cannot be purchased, sold, transferred for money, withdrawn or donated. A future paid service would require its own disclosed terms and payment authorization before any charge.
Eligibility and your account
You must be at least 18 years old to use Outpace. By creating an account, you confirm that you meet this requirement and can agree to these Terms.
Use a supported sign-in method and truthful account information. You choose your display name and are responsible for keeping your account secure. Do not impersonate someone else or access another person’s account without permission. Contact support@outpaceapp.com if you believe your account has been misused.
Health information and safe activity
Health access is optional. Granting health permissions lets Outpace read the permitted data on your device and sync the aggregates described in the Privacy Policy. You may revoke those permissions in your device settings. Revoking access does not delete data already synced.
Step counts depend on your device, health-data sources, permissions and successful syncing. Outpace does not guarantee the accuracy or availability of a device’s measurements. Competition deadlines and the treatment of missing or late data are explained in the Competition Rules.
Outpace provides social fitness competition, not medical advice. Choose activity appropriate for your circumstances. Do not ignore pain, injury or unsafe conditions to compete, and seek qualified medical advice when needed.
Fair use and conduct
Use Outpace lawfully and respectfully. You must not manipulate step counts or rankings through fraudulent means; impersonate others; post harassment, sexual content, graphic violence, spam or another person’s private information; infringe someone else’s rights; disrupt the service; or attempt unauthorized access to accounts, systems or data.
Do not use bots or scripts to manipulate the service. Do not reverse-engineer, decompile or disassemble the app except where applicable law permits you to do so. The reporting and blocking controls are available for concerns about users or content.
Your photos and other content
You remain responsible for the names, photos, reactions and other content you submit. Only upload material you own or have permission to use and share with the relevant audience.
You grant Vrtl Pirates LLC a non-exclusive, worldwide, royalty-free permission to store, process, resize, review and display your submitted content as needed to provide Outpace, including showing it to the friends or groups with whom it is shared. This permission does not grant Outpace ownership of your content or permission to use it in unrelated advertising.
Winner photos must pass review before publication. Outpace may reject or remove content that violates these Terms. Group admins and friends-circle viewers have the image-removal controls described in the Competition Rules. Removing content from Outpace cannot retrieve copies another person has already saved outside the service.
Outpace intellectual property
Outpace’s software, designs, graphics, branding and other service materials are protected by intellectual-property laws and belong to Vrtl Pirates LLC or its licensors. These Terms do not transfer ownership of those materials to you. You may not copy, modify or distribute them except as the service allows or applicable law permits.
Account deletion and termination
You may stop using Outpace at any time and request deletion from Account & privacy in the app. Deleting the app from your device does not itself delete your account. The Account Deletion page and Privacy Policy explain what deletion removes and what happens to shared groups, past results and play points.
We may remove content or restrict access to address a violation of these Terms, unlawful activity or a security threat. You can contact support@outpaceapp.com about an access restriction or moderation decision.
If your access ends, you must stop using that account. This does not remove rights you have under applicable law.
Service availability
Features may change as Outpace develops, and interruptions or errors can occur. Step counts depend on device measurements and successful syncing, so we do not guarantee that every measurement or result will be accurate or continuously available.
Nothing in these Terms limits a warranty, remedy or other right that cannot lawfully be limited.
Changes to these Terms
We may update these Terms. We will notify you of material changes through the app and identify when the updated Terms take effect. Where applicable law requires agreement to a change, we will obtain it. If you do not agree to updated Terms, stop using the service. We will not charge you for a future paid feature without the required payment authorization.
General terms and contact
If a provision is held invalid or unenforceable, it will be limited or removed to the extent necessary, and the remaining provisions will continue to apply. Nothing in these Terms limits rights you have under mandatory consumer law.
These Terms and the Competition Rules form the agreement concerning the free service described here. The Privacy Policy explains the handling of your information.
